Em 20 anos, 126 magistrados foram punidos com aposentadoria compulsória, diz CNJ
Às vésperas da votação, a senadora Eliziane Gama (PSB-MA), relatora da PEC (Proposta de Emenda à Constituição) que acaba com a aposentadoria compulsória como punição para juízes, militares e integrantes do Ministério Público, tenta driblar lobby para criar uma brecha na proposta.

Associações que representam os juízes tentam condicionar a perda do cargo à decisão judicial transitada em julgado. Pela proposta, a punição poderá ser aplicada em casos de faltas graves que tenham sido condenadas em processos administrativos, cuja tramitação tende a ser mais rápida.
Apesar da pressão, senadores resistem em encampar a defesa, tendo em vista o ano eleitoral e o potencial desgaste com a população.

Outra tentativa de alteração à proposta foi feita pelo ex-juiz e senador Sérgio Moro (PL-PR). Na emenda, o parlamentar restringe quais crimes poderia ser punidos com a perda do cargo, tais como corrupção, favorecimento a organizações criminosas e os cometidos com grave violência contra pessoa.
O relatório de Eliziane Gama será votado nesta quarta-feira (8) na CCJ (Comissão de Constituição e Justiça) do Senado. Ela não pretende acatar alterações porque acredita que o texto está alinhado à decisão recente do ministro do STF (Supremo Tribunal Federal) Flávio Dino.
No último dia 16, o ministro definiu que o CNJ (Conselho Nacional de Justiça) deverá aplicar a perda de mandato como punição mais grave a violações disciplinares. No despacho, no entanto, o próprio Dino determina que, uma vez decretada a penalidade, ela precisa ser referendada pelo STF.
A PEC é de autoria de Dino, que apresentou o texto antes de ser nomeado ministro do Supremo.
"Aposentadoria se destina a assegurar dignidade ao trabalhador que, após regular cumprimento de suas obrigações laborais, deve ser transferido para a inatividade. Esse pressuposto torna inadequada a utilização do instituto da aposentadoria (ou pensão por morte ficta ou presumida) para justificar 'aparente quebra' de vínculo entre o Poder Público e o servidor que tenha cometido conduta grave que acarrete alto grau de desmoralização do serviço público e perda da confiança nas instituições públicas", argumentou o então parlamentar.
Durante a leitura de seu voto, a senadora Eliziane Gama pretende elencar casos nos quais a aposentadoria compulsória aplicada como punição. Um deles é o do juiz Peter Eckschmidt, acusado desviar dinheiro de ações que julgava. Desde que se aposentou, ele vem recebendo, em média, R$ 93 mil líquidos mensais de acordo com o Portal da Transparência do TJSP (Tribunal de Justiça de São Paulo).
Outro magistrado que deve ser citado é Orlan Donato Rocha, do Tribunal Regional Federal da 5ª Região (TRF-5). Ele foi acusado de assédio e importunação sexual entre os anos de 2014 e 2022 contra funcionárias do seu gabinete.
